Can i sue or ask for compatsion from store for giving my iphone to a thife?

Ok what i want to know is can i sue a store for giving away my iphone to the wrong person when it was found by a store manager? my wife droped her iphone while shoping at a doller tree it was found by a store manager she then Paged every one in the store that they found it. Whille this was going on my wife was in the parking lot and she then. Walked back in to the store to get her droped phone after she saw she didnt have it. When she got in the store manager said she gave it to 2 girls that said it was theres they then. Walked out with it she filed a police report and we had the phone shut off. The store manager then told us she had the girls on the store securty video she showed it to my wife and then said sorry for giving the iphone to the wrong person. The chances of the police to find the girls are very slim to none. What i want to know is can i sue the store for the loss of the phone due to there faillur i mean an iphone isnt cheap its like 400 dollers to have it replaced and it had all my wifes data on it. She was smart and password locked it as well so they cant really use it.

Let's not get too sue happy. There ARE other ways than taking someone to court to be sued. Firstly, yeah those people who work at the Dollar Tree are clearly pretty stupid about returning it.. They should have asked a few questions about the phone, like....the phone number, and dialed it from the store. However, as dumb as they seem to you, maybe the dollar tree people were just nervous and thought they were doing the right thing. Also they shouldn't have to be the shepherds of anyone's lost stuff. It's a tough spot to be in. Dont think suing them is proper. You could contact corporate and explain and they might help you out. at the very least change their policy about returning lost goods. I would contact the cops and explain and see what they tell you to do. and just remember this. You can't really sue them because YOU (your wife, whatever) are the one that lost it. That's like if someone drops something accidentally in your front yard but someone else picks it up instead. It's not fair, and the staff there at Dollar Tree don't sound like the smartest people, but ...you guys lost it so that's what youre going to hear even if it sucks. Most places even have signs that say "Not responsible for lost or stolen property."-- this is everywhere. gyms with lockers even.
