Is family still eligible for COBRA/ARRA after I get a job?

Is my sister still eligible for FAMIS (Family Acess to Medical Insurance Security) in the state of Va?

  • My sister and her husband were unemployed for approximately 1 year and a 1/2. She got a job but makes less than $1,000.00 a month. She just found out she was pregnant a few months ago and applied for FAMIS and got it.So I know by herself she would still be eligible for this. Her husband however has now received a job making more than $65,000.00. He has not put her on his insurance policy because of a 3 month waiting period. They are telling me that even though he has a job making more than allowed in the program, (which is $45,100.00) she can not be taken out of the program because it was granted to her. So basically, even though he is making a lot of money, they think that they don't need to report this. I am confused because I don't want them to get into trouble with the government. But I can't see how they are still eligible, when he makes so much. I know that right now because she doesn't have insurance she is still eligible but my questions are 1.) After the 3 month waiting period at his job is up and he doesn't file her under his insurance, can she continue to get the coverage? 2.) If they don't report that he has this job making more than allowed what can happen? 3.) Once you and your family are in the program do you have to opt out once you make more than allowed? 4.) If Social Services doesn't find out by the time the baby is born, will they have to pay back pay? They said they were going to ride it out as long as they can. Basically just using the system to get free health care for her and the baby. Is this legal? Will this catch up to them? For example around tax time or can/will Social Services find out? They also have a 7 year old daughter as well which is not covered. This is really worrying me. Thank you in advance for your answers.
