Could we be sued for having a beware of dog sign and a no tresspassing sign?
-
Okay, My husband and I just bought a puppy, he is more than likely going to be a protective dog. We have been having people in our yard, and also had proof of them going in our outside basement . So thats one reason why we bought a puppy to raise it the right way and train it. So like a watch dog. My question is : If we put up a beware of dog sign all both gates and the back fence , and someone came into our yard (intruder) and for some reason the dog bit them. Would we get sued because that person intruder in our yard , and our dog was only protecting us?? Could we be sued because we new our dog would probably bite the intruder, and thats why we had the sign up?? I was just wondering because we dont want to be sued by anyone , our pup is really friendly. We just wanted to put up signs because its a warning that we do have a dog. Another thing is our dog has is a pup that loves to be in water, so we were going to buy a little plastic pool. for him to lay in and cool off. But one of my other family members said that if a kid got in to our back yard for some reason and we werent home, and that little kid drowned. Could we be sued also because that little kid tresspassed in our yard??? So the question is could we put up a sign that says no tresspassing. Would it be our fault that if the kid would come in and drown in my dogs little pool in our yard it would be our fault?? I am only asking this because there are people coming in our front gates litterally in our front gates when we arent home . There are kids climbing over the back fences too. I dont know why no one is watching them, and My husband and I just want to make sure that everyone is warned that we dont want tresspassers, and we have a dog in our back yard. I dont understand if we should put up the signs our not, My husband and i dont want to be sued, because people are coming in our backyard. Note there are little kids, that could becoming in our backyard, they might not no how to read. There are kids on the side that do know how to read and are older . I just dont want any of them hurt. But there have be older people who walk up and down our alley that stirrs up all of the dogs at night. So its kids and adults.

Answer:
There's no law against putting up signs; in fact, it would be a good idea liability-wise to give warning. Most dog-bite statutes do not allow trespassers to sue for an injury. The owner is liable only if the person injured by a dog was in a public place or "lawfully in a private place." That means that the injured person must have a good reason for being where he was. Mail carriers, for example, are always covered. Police officers performing their official duties are not considered trespassers, either. Neither is anyone else who has an invitation, express or implied, to be on the dog owner's property.

If anything happened like for example your kid scenario you would be sued but seriously i doubt you would be guilty one because of the signs and two the parents would look bad because they are bad parents and not keeping tabs on their kids. As for the dog biting an intruder you will not be blamed you not only had a beware of dog signs but don't trespass and you're only protecting your property which is your right as a homeowner but let's say the dog ja out of the fence area around your house with no aupervisoln or leash then yes you could get in serious trouble.

First of all i suggest u need fix ur fence nicely with locked gates so that your pup don't go beyond your back yard and eat somebody LOL and no kids going to come to your pups mouth LOL. Then its your backyard why people tresspassing is that a shortcut to some where? License for u pup is important too. I think you could be sued if u did not locate the warning signs to alert neighbours.
