What does a minor do for you?

What would happen if somebody assulted a minor before the minor assulted them?

  • Someone explain this please... Firstly what is a minor in the uk? 16 or 18? What would happen if a minor assulted a non-minor first? Would they get into as much trouble if a non minor assulted a minor first or just as equal trouble? How far can a non-minor go to defend himself if he is getting beaten up really bad, and it be ok? Also if somebody hits you first, and you beat them up, would that just be self defence? Thanks!

    Why do people constantly include the information that an assault involved a minor? It makes no difference, assault is assault, and whoever acts first is definitely guilty of assault. Whoever strikes back MAY be able to claim self defense, depending on the extent of their actions. Self defense means taking reasonable action to STOP the attack. You must always (in the UK and most sensible places) use flight as your first option if it is reasonably available. Retaliation or continuing the attack after the original attack has stopped is NOT self defense.

An assault charge doesnt really take age into account, obviously there are acceptions. I think a Judge would consider the origins of the assault, i.e who provoked who? Who threw the first hit? Chances are whoever threw the first hit will be the one in trouble. Also I believe self defence would cover your back if you retaliated, especially if you didnt beat him/her too bad.
