Am I being sexually harassed?

Are these ground to sue my school or get my job back? they rehired a persson who Sexually Harassed me because?

  • they 'lost the report' i sent a year ago. Her contract was terminated for poor grades so she took a semester off and then they rehired her and put have to work with her on the same staff.' I am student resident assistant so we write formal reports on underage drinking, drug use, etc....its my job to write reports when we observe something wrong. We'd been working for the past few months together again and it has been extremely stressful/uncomfortable. no re-occurrence of sexual harassment has occurred but this uncomfortable atmosphere made me make a mistake and im being fired for it. The mistake occured outside of my job but basically it contributed to my irrational thinking. I found out after i got fired that my emoyler (the university) wasn't aware that i had been sexually harassed by this individual even though i had written a formal report about it. thanks. I dont really want to sue the school...i mostly just want my job back though (i wont be working with this offender next year if i get my job back)..also i DO HAVE SOME EVIDENCE OF THE SEXUAL HARASSMENT. also thoughts on the situation? OPTIONAL READ BELOW if your curious to see why exactly i am gettting fired: If it matters, im a student leader and i didnt act as a leader for about 5 minutes, by basically not being a perfect human being 24/7 and i got fired. My gf who cheated on me said she'd hold up a sign saying she cheated on me on campus walk. She did voluntarily, it was my idea though, but i stopped her after 5 minutes- surprisingly she didnt appear embarassed. Someone told on me. Love does crazy things to your head coupled with working with somone who was sexually harassing you. they said since i ridiculed someone in public im being fired. My gf even thinks its ridiculous. Obvi what did was wrong but to be fired....cmon

  • Answer:

I do not think you would have a strong case in a lawsuit, for either damages or for getting your job back. If I read this correctly, you did not advise your HR people (or whoever handles these things in your work environment) of the discomfort and the earlier complaint. It also appears that your action with your girlfriend would have happened even if this other person was not working with you; the two don't seem to be related and I think you would have a lot of trouble trying to link them. And they are usually quite aware of what they can and cannot fire you for; universities are not little businesses that don't understand the laws.

The actions of someone supposedly in charge speak volumes of maturity and if a person is doing such childish misbehaving then they should not be held in a position of authority representing or working for a place. As to the sexual harassment so much of it is taking place all over the country you may get some were with it but also any and all of your other actions are going to come up are you ready for that? How much dirty laundry are you willing to hang out on the line for this and wouls it or sould it be better to move on down the road and let this all fade away?
