Does the Service-members Civil Relief Act cover members being involuntarily separated from the military?

  • I am separating from the military and being sent back to my home of record, my landlord doesn't want to release me or my room mates (1 military co-worker and his civilian g/f) and the rent is 1800 a month. There is no possible way that I will be able to swing my portion of the rent considering I will be homeless and jobless at least until I get set back up on my feet... Is there anyone out there that knows the law well enough to help me out? I called the legal office on base and they said it would be another month before I could even ask them some questions... ridiculous...

The key to this sentence, copied directly from the CRA are the last four words: while on active duty. You are being involuntarily separated from the service and in being removed from active duty you are not protected by the CRA. Whose name is on the lease? If you are the lease holder, too bad for your room mates. If it is a shared lease, you will lose your portion of the security deposit, but again, your room mates will have to suck it up or move. All is beyond your control, so focus on wrapping things up and move on with your life. Good luck to you.
