Can my son get out of probation, charges, and fines?
-
A few months ago my son who is 15 years of age was alone at home shooting a BB gun at cans and had a one of my beers without my permission beforehand. My son is an only child. But he is by far the most intelligent, kindhearted, creative person I have ever known. He can hold the most brilliant conversations. He overall has the most amazing responses to any question. He can give you the best advice. I look up to my son. He is just so amazing. But anyways, someone saw him in my backyard shooting a BB gun and called the police. The police showed up at the backdoor and he answered and they grabbed him, and used strong intimidation against him to the extent where he cried, confessed, and was arrested. He told me he didn't know his rights. Didn't know what to say to the police. And they consequently used that against him and took advantage of the situation. We went to court and he was charged with possession/shooting of a BB gun and was put on probation with a lot of regulations he has been ordered to follow. The probation will cost well over $1,500. So my question is how can he get off probation. The officer who arrested my son restrained my him of his liberty by word's and act's which he feared to disregard. The officer put his arm inside of my house and grabbed my son's arm firmly. Would that be in violation of the 4th amendment? As my son didn't consent to him entering the house. Does an arm count as violating the 4th amendment? Is there anyway we can get out of probation? He gets good grade's and doesn't get in trouble with the law. I don't believe he deserves this probation. Please tell me if there's anything I can do to get my son out of these charges, fine's, and probation. I live in Michigan if that helps.

Answer:
Whoever that officer is disgust me. I would think it is violating him since he honestly didn't know what he did wrong. I would try and go to the county court and see if it's really violating the law. I can't think of much more, but good look to you and your son. I hope everything goes your way.

All these legal questions should have been handled by his attorney. "The officer who arrested my son restrained my him of his liberty by word's and act's which he feared to disregard." This makes no sense. "The officer put his arm inside of my house and grabbed my son's arm firmly. Would that be in violation of the 4th amendment?" When confronting an armed individual, then the first thing to do is to detain that person. The Officer did not need consent to detain your son, as it was a lawful detention. The Officer did not search the house. Since you are beyond that, then one would have to assume that there was no inappropriate action. Now, I might hazard a guess that because he is only 15, then you are stuck with the $1500.00 bill. So, the answer is, no, if he is on probation then he has already been found guilty, right? Can't get out of it. No, being put on probation is his sentence. The other option is juvie. No, YOU wll not get out of having to pay his fine.
