Do you have to call after sending an application?

Please help: ilr invalid application?

  • Im on the old work permit from April 2007 - 10 April 2012. I sent my application for Indefinite Leave to Remain(ILR) on the 10/04/2012(so, in time) however got all my documents returned to me on the 21/04/2012 saying that my application was invalid because the forms for SET(o) changed on the 06/04/2012 and the fees had increased. Because the fees changed, my application is invalid. I have plenty funds however they didnt even call to notify me this change which could easily have been dealt with. Now, my work permit has expired. They have said to send another application with the new forms but Im not protected by the Section 3C. What do you think my chances of getting my ILR granted sending the new application? Any help/advice is appreciated.

  • Answer:

It's not UKBA's responsibility to inform you of any changes to the rules involving forms or fees, it's yours to be aware of it and check that your application s made on the right form, with the right fee and that you meet the conditions currently prevailing for the visa you are applying for. If you don't take the time to check that you are making a correct application that's your responsibility. God knows it couldn't be easier now that everything is online. Send the new -correct -application in immediately. There is some allowance on the basis that you made the initial application in time (barely). Sending it in on the very last possible date was risky since you could have applied at any time 28 days prior to the 21/4.
