A cable company has billed me too much after I discontinued with them?

Can you sue a company in small claims for being a monopoly?

  • My local cable company keeps raising the prices every 6 months and you don't realize it until you go to pay your bill (which are billed a month in advance, so I can't sue for unexpected charges). The only other internet provider is through land-line only and tend to be incredibly slow not to mention I would be forced to buy a land-line service on top of the internet. Therefore, the cable internet service is monopolized and I can't get a better deal with the only similar competition without purchasing an unwanted service and without dealing with a similar product that can never be as fast as the cable. But I don't want to deal with litigation and I know small claims has less options that would allow the company to drag things out for years. So, can I sue them in small claims? They are a monopoly, right?

  • Answer:

It is not a crime to be a monopoly. But in any event this is by no means a monopoly. Your current provider offers a better service, not the only service.

You said yourself that there is another option. Just because you don't want to use it doesn't mean there is a monopoly, and no you can't sue in small claims.
