Where i can find all the EU laws that indicate my rights?
-
And i mean not only the human rights, but all the rights i have as a citizen of EU. In addition i need any extra laws that apply to UK and Cyprus if possible. These laws would describe for example when you are allowed to film, what are your rights when stopped by police, etc. I want to educate myself on these legal matters as education and therefore government has failed to educate me with this important knowledge which is what i believe more important than any of the required teachings. Thanks.

Answer:
"Human rights" are little to do with the EU. The Council of Europe (of which the European Court of Human Rights is a part) is NOT one of the EU institutions. The European Court of Justice is part of the EU, the ECtHR is not. All your rights which arise under EU treaties are to be found in the Consolidated Version of the Treaty on European Union. This treaty is simply a consolidation of existing Treaties, such as the Treaties of Rome, Maastricht and Amsterdam. The Treaty creates the framework of the EU - its institutions such as the Central Bank, the Euro, the Court of Justice, the Parliament etc, creates the single market, the customs union etc, and sets out some policy concerning the individual, for example the right to travel around the EU, the right to work in other member states, to move capital around the EU etc. Treaties, Directives and Regulations form the law of the EU and they apply in ALL parts of the EU. If it applies in the UK it applies in Cyprus, Germany, France and all the others. Member states must give full effect to Treaty provisions and Regulations. Directives must be enacted by member states by the date given in the Directive. All these Treaties can be found on EU websites and especially on law databases. Since national law must yield to EU law, there is little in the way of national law relating to EU law, save for the law which actually ratified the original treaty. In the UK this was done by the European Communities Act 1972, which confirmed the UK's membership of what was then called the EEC, and it's successors, and made it clear that the Treaties and any legislation (at a European level) arising from them in the future were to be considered the law of the UK. Rights when being stopped by the police are nothing to do with EU law, which is overwhelmingly to do with economics and employment, movement of goods etc. It is touched briefly in the European Convention of Human Rights (1950) and the Human Rights Act 1998, that says that anyone arrested must have his arrest explained to him in a language he understands, and that he must face a fair judicial process which is neither unduly fast nor unduly slow. The nature of European law and of Human Rights law, which is in the European style (of continental civil law systems) is that meanings are very wide, rather than specific. Specific legislation in the UK on how the police must handle suspects under arrest is to be found mainly in the Police and Criminal Evidence Act 1984. Banning people from filming things is a matter for member states, not EU law. People should not run away with the idea that Human Rights legislation (which, in some form or other, has existed since 1215) means that people can film this, or can't film that, or can't be arrested for certain things. Criminal law is a matter for the UK, not the EU, or the ECtHR. Even if the ECtHR said the UK has infringed someone's human rights, it can request the UK change its law to comply with the ruling, but cannot insist on it. The EU can, in relation to EU matters, insist that the UK enforce EU law, or give full effect of any rights arising from it to its citizens.

It is not possible to comprehensively list all the laws which give you rights. Firstly, a substantial part of the law in the United Kingdom and Europe consists of the binding decisions of courts, like the Court of Appeal and the European Court of Justice. Second where rights are expressed, they are expressed in a general way. You are unlikely to find a statute governing your rights to film. The rights listed in the Human Rights Act 1998 in the UK, for example are not generally absolute rights - they have qualifications and many are subject to proportionate limitations. The law is far from simple to understand. Lawyers spend their entire careers trying to learn all there is to know about one particular corner of it. However, you should be able to find some useful guidance, at least in the case of the UK and Europe on government websites. The UK government has put out several booklets of the "know your rights variety" talking about the rights of citizens who are stopped by the police. In addition the Police and Criminal Evidence Act Codes of Conduct are freely available online and provide guidance for police conduct. Your rights under European Union law as such are rather limited: the EU, for example, does not impose human rights law. Even though the convention of which the UK is a member is called the European Convention on Human Rights, it has nothing to do with the EU, predates the EU and is separate from European Union law. EU law tends to give broad economic rights which are designed to prevent national government from distinguishing between the citizens, businesses and good of member states. So, for example, within the EU you have will generally have a right to travel freely, subject only to the same restrictions as a citizen of each member state.
