Legal Music in Skate Videos?????
-
Do skateboard companies take the time and money to pay for EVERY single video that they post of their sponsors skating so that it's not copyright? yes or no? do they also pay for the music even if it's only on youtube? its still considered promoting the company but if its on something as minor as youtube does it legally still matter? can they get sued? reason why i am asking this is because i recently created my own brand and we have our first skate sponsor and i am not sure what to do about the music for his skate videos. he is going to have a lot of skate parts and we will eventually get more sponsors and my brand doesnt have the money to pay for the copyright rule/law nor do i even know what the law is?? i want to just put the videos on youtube and facebook (and when we make ourselves a website) but i do not want to get in trouble for using copyright music. please someone help me clarify what i can and cant do with music and how the law actually works so i can by pass it legally

Answer:
All created stuff, written, film, pictures, lyrics, music (any thing what so ever) is automaticly copyrighted as soon as it is created. There are different sorts of copyright though. Generally skate videos don't have rights to the songs they use. If your planing on making money off your video then DON'T use music with out a release (permision), because it can back fire on you real easy. You can use any thing with a Creative Commons copyright licenses, you can find plenty of music under this licenses and its free. Also talk to any local bands or independent bands and many will be more than happy for you to use there music as it promotes them too. Your also not paying for the copyright rule/law, your paying the owners of (in this case) the music to use there music because they have worked to create it and like you need to make a living as well. You will not have to pay for all stuff though, it changes in every case. Also you tube is defiantly not minor, if you do use something illegally one of the worst things you can do is put it on you tube, as you will be giving it to the whole world. I work in the film industry as a marketing and promotion manager and deal with this stuff every day, in a sense.

Copyright is free, instantaneous and automatic from the moment the producers put sounds on tape or into digital memory. No registration is necessary until and unless they decide to sue you for using their recordings without permission. As a general rule, all sound recordings are copyrighted in the USA. Those made prior to 1972 are covered by state laws and those after that are covered by federal copyright law. It is POSSIBLE to obtain a publication license from the producers or from ASCAP. Some producers even offer "royalty-free" licenses for various purposes, including the Creative Commons licenses
