Can I collect unemployment benefits?

  • Hi, I am an untenure teacher who has been working for 7 months before I was let go "discontinued". I am filing for unemployment but they said that I will not be receiving unemployment benefits. I do not understand why I cannot receive unemployment benefits? I am an "at will" contract employee. Can anyone please clarify why I would not be able to receive unemployment benefits in NY? Thank You

    who told you that you could not receive benefits? if it was the state it will say exactly why on the letter you were sent. your employer cant tell you if you can receive benefits or not because its not up to them and has nothing to do with them if you can qualify or not.

The reason you were declined should be on the letter of determination you received from the unemployment office. They usually don't 'tell' you if you will collect or not, you get a letter. Also, it should have detailed an process you can go through to appeal the decision. Did Unemployment send you a letter that you were declined, or did someone from work tell you that you would not be approved? In general, contract employees and teacher do not qualify for unemployment except under special circumstances in NY, but they encourage people to apply, and they decide on a case by case basis.
