Unfair work place, are there rules/laws that business owners must follow in the state of virginia?

  • My boss is Turkish (angry), owner of this house remodel workplace that I work for (total of 10 employees). I am looking for a new job, I want to say this before explaining everything. First off, I work 48 hrs a week. I make $16,000 a year salary... I know, crappy. But anyways, Its 1000 a month after taxes which is about 5$ an hour after taxes. Is that like legally paying me? However, I am not too worried about the pay, HE YELLS ALL THE TIME... I will get blamed for everything even if it is clearly not my fault and he will scream at people. Another thing, everyone gets a lunch hour everyday here and 8 of us work 6 days a week, and 2 other people only work 5 days a week. I recently started working Sundays because an employee quit and they plugged me in for Sundays and I am the only one here at the showroom on Sunday. I closed the shop for my hour lunch and the next day, he yelled at me and told me I cannot take lunches on Sunday because he doesn't want his shop to close ever. Is that fair? I work 8 hours a day 6 days a week, and everyone else gets a lunch hour everyday except me? This company is very very unprofessional and I am looking for a new job. But until then, is there any laws against business owners yelling at employees and giving them unfair hours like that?

IF you work over 40 hours a week, depending on the job, or 80 hours a pay period, you have to be paid overtime pay. Also, you must get a half hour off for lunch and two fifteen minute breaks, for every eight hours worked. BTW - All this needs to be posted in a common area, like near your time clock. As for the yelling, nothing wrong with that legally. It is his business and he can yell. He can't hit you or use racial slurs, but he can call you an incompetent donkey if he wishes.

At $16000.00 per year you don't qualify under federal law to be overtime exempt. You must make at least minimum wage which $7.25/hour before taxes for all hours in a work week up to 40 hours. For any hours in excess of 40 hours in a work week you must be paid at a rate of 1.5 times your normal hourly rate. If you aren't making that much per hour contact your state's department of labor.

The federal minimum wage is $7.25 per hour before taxes. It sounds to me like you are working 43 hours a week (seven hours each day five days a week and eight on Sundays). You should be getting paid three hours at time-and-a-half each week because you are entitled to receive time-and-a-half for hours over 40 per week. This comes to $290 for the 40 hours at the regular rate and $32.63 for the three hours at overtime, a total of $322.63. There are not any laws prohibiting business owners from yelling at employees or giving them unfair hours like those you described. You might want to ask if you could bring a sandwich or something that you could eat on Sunday when business is slow. Good luck.

Yelling is not illegal. neither is requiring you to keep the shop open on Sundays. However, the fact that you don't make minimum wage, even in a salaried position, is illegal. Contact your state's dept. of labor.
