Would this be considered an attempted break in?
-
I live in eastern North Dakota but have been working in western North Dakota through my employer for the oil boom activites. I just got home earlier tonight after working a straight 10 day shift in the oil field area. Someone buzzed my apartment twice and since i was expecting nobody i looked outside and saw no familiar vehicles. Shortly after i heard a pounding on my apartment window since i live in the garden level. I peeked out the window and saw someone in dark clothing walking around the building on a cell phone. Ten minutes later someone was trying to open my door which was bolted shut, i looked through the peek hole and saw an african american wearing a hooded sweatshirt with a straight brim baseball cap, and two other men lingering in front of my door. I quickly grabbed my 12 gauge shotgun (dont worry i use it for bird hunting during the fall months). He was talking but it was not english or any language i could comprehend for that matter. He knocked and tried turning my door knob for about 3 minutes before my neighbor who is a foreigner walked by and from what i got out of his lingo was "white man lives there". The man tried about 30 seconds more before he left and was never a bother again. i looked outside my door and there was a scratch across my apartmet door, i am from a small town and never had such an encounter before. It was like he knew who i was and wanted to see me or wanted in my apartment. It was too late to call my aparment office and was too doggone tired to call the police and have them come over to file a report. Do you think this was an attempted break in or just was a misconstrued aparment the guy was looking for? I dont know what to think but either way i will tell my landlord first thing in the morning, what do you think? im just looking for some advive from the outside looking in instead of inside looking out.

Answer:
The person knocked on the door, and turned the handle to see if it was open. They did not break in They did not enter. Therefore................There was NO break and enter. It was a knock on the door, and a turn of a door knob, which is not against the law.

It was probably just that he thought it was one of his friend's apartments, but I'm not sure. Even if you do know someone it's really strange to think you can just walk right in their house. If I were you I would keep your shotgun close by whenever you're home and make sure to lock before you leave the house. An alarm system would be nice, too.
You could file a report with the PD, and you should let your landlord know because the door was cosmetically damaged, however if the person wasn't trying to jimmy the door, break the window, or pick the lock it technically isn't an attempted break in. It really isn't a crime at all. But because it was odd behavior I would report it.
