Do I need the cemetery plot owner's consent to move my wife's remains in Texas?
-
My 38 year old wife of 15 years died suddenly and in all the shock, was buried in a plot owned by her parents. In the state of Texas, can I have her moved to my family plot in another town in which my family and her children will be buried. Do I have to have her parents' consent to move her remains since they own the plot or do I have spousal rights to move her to our family cemetery?

Answer:
You would need consent. Truth be told, your wife is not here anymore. The body may be but her soul has moved on. It would be best to leave your wife's body where it is for the following reasons: 1) Financially more sound 2) Keep the peace in the family 3) Let her rest.

If her parents own the plot, and are still alive, you would need their okay.
