Getting less hours from 30hrs to 15 hrs a week working in JCPenney. Can I file unemployment if I quit?
-
Due to my availability I only get at least 30hrs in a good week bad 20-25hrs but now with the new system changes they were cutting cost that's include getting rid of some of the unnecessary registers and fired at least more than 20 employees. For the last two months 1 person working on a one quad, jobs include cashiering, folding, cleaning the fitting room etc.... so much work for one person to do all that. I don't complain over that because there's only so much you can do. Managers are pushy, and lazy. Last week I'm scheduled for 3 days only. I though ok maybe I need a break to take care of my sick kid and work on the house. This week my hours came back up like normal but then for next week went back to 3 days only which is15hrs. I just checked my schedule for the 3rd week of April and I'm shock to see that there is no work schedule for me at all.... I don't know what to do... by the end of May i will get the company's money that they match on my retirement so If I get fired before then I loose it.... Is this even right? Can I sue them if this happened? The way JCPenney worked is that they are playing on your hours until you get none hours so either you quit or you just get automatically kick out of the system basically fired... My question is shall I wait till the system kick me out or get fired to claim unemployment? Am Ieligible to get unemployment if I quit due to no more hours? I don't know what to do.. please help!! thank you...

Answer:
The weeks that you work 15 hrs, you actually may be eligible for partial unemployment. You should check it out. Don't quit!

Sorry, but you're not eligible for unemployment if you choose to leave. You have to be let go, fired, terminated, downsized.....by the employer.

Please speak with your supervisor regarding your job. You have a LOT of misinformation regarding this company. With your perspective on how you *think* things are, it's really no wonder you're frustrated.

Yes, if you call them a couple weeks beforehand and cry really hard.
u should get partial unemployment contact the unemployment office asap and fill ur claim for instead if your regular hours where 40 and now you get only 20 you are eligible to fill unemployment for the remaining 20! the sooner the better so you won`t loos your benefit you paid into! good luck btw if u have union speak to them if not talk to free or low coast legal service for ur retirement plane, u could find local offices online google it!
