I was a passenger in a car accident and need help w/ car insurance ?

I have a question about about insurance involving being a passenger in a Car Accident. Thursday Night I was a passenger in a highway speed car accident. A car cut us off on the freeway causing our car to lose control and smack into the center divide facing the wrong direction. The car who cut us off just drove off. There were 3 of us in the car and I was sitting in the back passenger side where the brunt of the wreck occurred and suffered the worse injuries. I was rushed to the ER as a trauma patient. While I was in the hospital I was over seen by the trauma doctors and received pain medication, X-rays, CT Scans and a MRI. I was in the hospital for around 20 hours. and sustained injury to my right lung, rib bruising, whip lash, knee injury, head trauma and trauma to my left knee along with all over bruising and pain. Now here is my question part 1 1.The driver of the car has insurance, but has said something about it only being able to cover $15k of my medical bills. Do I need to get his Car insurance information and what do I do with that information? 2. What if my medical bills go over that "15K" Does my own insurance cover the rest? 3. I with stood alot of non life threatening injury but am immobile for the time being, can I get some sort of payment for pain and suffering, or do I have to sue my friend for that, which I dont want to do becuase hes my friend. 5. What if I have injury that need attention later on, does his car insurance take care of that or does my medical insurance have to cover that. 4. Who do I call for more information and what I need to do. Just to add insult to injury- the hospital I went to treated me like **** the entire time I was there, they did not listen to my pain and injury comments, left me in a C collar for over 8 hours even though my x-ray and cat scans came back normal, they with held pain management for most of the time I was there, only giving me doses of pain medication maybe every 6 hours when it was clear I was in more pain and need more medication, they accused me of seeking drugs even though I was clearly in pain after hitting the center divided going about 50mph. They ignored my pain, trouble breathing, my knee and lower abdominal pain, They went hours with out talking to me, while caring for the patients all around me. they said on more then 3 occasions they were going to admit me but never did. They didnt feed me, give me water, they never asked me how I was doing, they were rude and clearly did not have my health in concern. Is there anything I can do about the poor level of treatment the hospital gave me? I am beyond angry that I was so openly mistreated. Thank you

All you need to do is contact the insurance company that is covering your friend and start a claim for your medical bills. They will pay up the limit of his coverage. You say it is $15,000. Then that is the claim. You ask about you car insurance. Sorry, the best source of information is your car insurance agent but I expect they shall not cover anything that happens to on you on another car. Your medical insurance may cover the rest of the bills. Contact your medical insurance company. You ask about injuries surfacing later. Same information applies. You present all bills to your friend's car insurance company. When his limit of coverage is reached, then, that is it. As far as the hospital is concerned, sorry, hospitals are hospitals and not first class on a ship. For any complaints about them you need to complain to them. Probably a waste of time unless you sue and for that you need evidence. Guess who has the records? Yep, the hospital. Sorry about your injuries. Would it be fair to ask you if you were wearing your seat belt? I gather from your injuries that you were not belted. Sorry if I am mistaken. Best of luck and I hope you recover soon.

You said you were given pain relief , had an x ray , ct scan and an MRI wow , you are so lucky to have had all that all in 20 hours of arrival. In the U.K. you would not get a MRI or a CT scan for a routine car bump that does not even require you to get admitted. The hospital staff were obviously busy treating all the other patients around you , as they were also in need of some medical attention.It seems you are very angry but you do not realise just how lucky you have been getting expert medical help. They left you in a C collar for over 8 hours as that is good practise , bruising may occur and take some time to appear , your treatment seems to me to be very very good. Having a lower abdominal pain may be a good reason for not feeding you as the last thing you need is your digestive system working while you may have had an undetected injury while they were waiting for you ct scan and mri results to be processed. As for paying for your treatment , your friend who was driving swerved to avoid another car and drove in to the central reservation , seems like bad driving to me. Hope the police were called , there report will advise as to who was to blame for the accident. You need to make a claim against your friends insurance , so i recommend you get a lawyer.

The owner of the car that you were in, and the driver of the car that you were in both must give you information about their insurance. If they don't, you can get a copy of the accident report (in California, this absolutely must be in person, and the person who was injured, no matter how old or sick they are, must personally pick up the report and they are not allowed to assign that job to a relative). I tried to get a copy of an accident report from the Department of Motor vehicles, after a relative's house was hit by a car, and I was not able to use the durable power of attorney to obtain it even with my written note of authorization from the home owner. The relative, who owned the house, had to personally come to the DMV office and get it. There were not supposed to feed you or give you water until they ascertained the extent of your injuries. If your intestine was perforated, food or water could have leaked into your abdominal cavity. Some patients are also on water restricted diets due to edema (swelling due to water retention). Such edema gets worse when water is administered, and it could restrict the heart and cause death. Hospitals don't treat patients well, and skilled nursing facilities for the elderly and extremely ill are even worse (often not changing pooped pants and bed linens for a day at a time). Nurses don't come when summoned. Yet such facilities meet or exceed Federal and state standards because said standards are based on certain criteria (which have little to do with patient care). Standards might require that a certain number of nurses are assigned to you (but those standards don't require that they work). Often the staff is in the break room, sometimes discussing the felonies (rapes, etc.) that put them in prison (though it is against state law to hire prisoners for such work). If you don't get anywhere with insurance companies, you can contact the state insurance commissioner (file a complaint). You can also take the matter to court (small claims doesn't use lawyers, so you can save money).

1. Yes you need the car insurance info. You use it to contact them and make a claim for your injuries. 2. If your bills exceed his limits, you can make a claim on your own auto insurance for the excess. 3. Pain and suffering comes out of the same coverage as your medical bills, so if there isn't enough to cover your bills, there won't be enough to get any p&s money. You would have to sue your friend. 4. Call your own insurance agent. 5. See answer #2 And lastly, you were treated like a patient with non-life threatening injuries. You were given pain meds at regular intervals, not on demand. When you demand more frequent pain meds, it makes you look like a druggie. That's why they said that. Pain meds, particularly narcotics, can ONLY be given so often, because they can do more harm than good if the directions are not followed. This is an American hospital I assume? What public hospitals in your world do they give constant attention to every little whim of each individual patient? You received exactly the level of care you needed. It is not the emergency room's job to see that you are entertained, fed, and pampered. Their job is to observe you for serious complications and to stabilize you enough to get you out of there. You were left in a collar because that's what your injuries dictated. You were not fed, just in case there were internal injuries, that would have been bad. You were not given constant minute-by-minute attention because you were not the only patient there. They didn't ask you how you were doing probably because they thought you were a big whiny complainer, and wanted to stay as far away from you as they could.
