Are you donating money to Haiti relief?

I was caught stealing money ($150) from the Haiti Earthquake relief fund at Wal-Mart, was assulted, lawsuit?

  • I was in the store, and at each register they were asking people to donate money, there was a register with a jar of money it in, i thought nobody was looking, i walked past it, put my hand in it, and took all the paper money in it. One of the customers grabbed me and had me in a retraint on the floor. Other customers came alone and held me in a restrint until the police got there. I was laying on the floor, and 100s of people saw me, and i couldnt get up. This was a total nightmare, I was so humilated. I was arrested, and released with paperwork. I have to appear in court on feb 9th. I hope i just a warning. They let the guys who pinned me, go free? Can I press charges against them, to throw them in jail? They took the money off me, and put it back in the fund. It was about $150. They got the money back, so i dont understand why i was arrested?? Can I file a lawsuit against wal mart for allowing this? They did not intervine, they allowed the customers to pin me to the floor. If I knew i was going to get caught, i wouldnt have done it. Do you think i was just get probation?

    Aside from commenting on your moral character, No a lawsuit against either the customers or walmart for two reasons. First, this is not assault. Assault involves a threat against you. What you mean is battery which doesn't apply since you were not injured. The only thing that you could possibly charge would be wrongful detainment or whatever its equivalent is in your state, but since you actually did the crime this would be thrown out immediately. Against walmart the only claim you would have would be emotional damage, since you were not injured, but again that does not really apply here. Emotional damage is a fairly difficult charge to prove without physical damage to go along with it, and a injured sense of pride doesn't really cut it. Focus on your own court date for now any other legal action will just be thrown out and distract you from what is important now. As to what your punishment will be it could range from community service, fines, probation, all the way up to some jail time. Play your cards right though and make a plea and you will most likely get a small fine and probation. Don't try to fight the charges since there were so many witnesses and video evidence.

nope, you can't do that, the judge will laugh you out of the courtroom. As long as they didn't use extreme force to keep you there it's considered a citizens arrest. The pain and suffering you received while you were on the floor would be argued caused by your own actions. This is definitely a little extreme, but it'll never hold up in court. You'll probably just get probation, especially if you're under age, but take it from a guy who's been in front of a Judge before, you wanna get off easy, you gotta suck up. Be polite and act like it was the worst decision so far in your life. If the Judge thinks that you aren't sorry about what you did, then they will make you sorry. Believe me, it works.

omg. first no lawsuit. you didn't get hurt, maybe emotionally, but come on dude. you stole, even thought you didn't make it out of the store, you still took the money out of the jar. and no i look at those ppl that pinned you heros. cause the people in haiti need the money more than. and youll probly get a fine.

LOL you have no case... first you stole (breaking a law) from a charity (no morals) second no extreme force was used, no1 beat you or such and the pain&suffering will get tossed out by any judge because you only feel tht way since you were caught

Stealing is against the law. Stealing from a charity fund is also morally very wrong. I hope you feel sorry for what you have done. The money doesn't get to the people that need it because the government in those poor countries usually keeps it to itself but you are not any better. You really shouldn't do such immoral acts. I doubt they will throw you in jail. You will probably have a warning and to pay an amount of money.
