How do I sell a patented product?

  • I have an idea for a product..the problem is that my idea falls under the umbrella of another patent/s I believe.. yet for some reason no on seems to be making a product targeted at a great niche market. The products being made are super high priced and aimed at wealthy customers.. I want to make my product marketed to a niche market but very cheaply. So how can I get around this? I am not sure the status of the patents.. they might be expired.. i need to check. Is there a way I can still manufacture and sell it?

    First, you have to have something novel, unique, or non-obvious by those skilled in the art in order to have a patentable item (utility patent). If you have such, it may still be patentable, even if it infringes on an existing patent. For instance, a glow-in-the-dark umbrella which shows where the shade is at night might be patentable, even though it infringed on other umbrella patents. That is, you could still get a patent, even though you could not build it without permission from others. The reason you would do this is your patent would then prevent THEM from building your glowing umbrella. You are then in a position where you have some protection in place, and can speak to umbrella companies about licensing your idea. However, if you prefer to manufacture and sell it yourself, you will have to license their technology as protected by their patents. If their patents are expired, this is not required. Best procedure is to: 1) put your idea down on paper, 2) discuss it with a patent attorney, then if recommended 3) have a patent search done, and if no interference is seen, 4) file a PROVISIONAL application. This is much cheaper than a non-provisional utility application, and will give you a 1 yr window to proceed with a full non-provisional application which will claim the priority date of the earlier provisional filing. During this time you can meet and talk with companies to see if the expense will be justified. Good luck.

Just like everybody else my budget is extremely limited, but I do have over 5,500 pieces of the product already packaged. I also have business cards, letterhead, and envelopes made up with my company info and logo, I also have brochures and a website with a product logo and information on the product. I would like to start obviously by moving my current inventory. My question is that is it easier or cheaper to sell them on my website or try and find a retailer or distributor. Also where do I find distributors for this kind of product, I searched the internet and can't find any. I've gone to retailers websites like Lowe's and they give an address for potential vendors to send a letter and info of their product, but does that really do any good? I heard most companies, especially the big ones don't even look at those letters. Any advice would help, I need some advice on which direction to go. Thanks

If your product falls under the umbella of patents held by otehrs then you should contact them to obtain permission to produce and market your product. If they are not interested in that market they may grant you the the rights to do so for little or no money. Do check on the status of their patents, though. Check for expiration and also if they have been revised. Often patent claims are challenged and certain claims of the patent are disallowed. So the claims you may be interested in may no longer be covered by a patent. If you find that the patent is still in force, then, legally, you must work through them to obtain the rights to produce and sell.
