Apartment complex sent me to a collection agency?

I lived in this apartment complex earlier this year where my roommate ruined the carpet. I knew that we would need to pay and so I was expecting a call from them. Several months go by and no call or correspondence from them regarding the carpet and so I thought that our deposit covered it. I get a letter in the mail yesterday from a collection agency saying that my apartment complex sent my account to collections. There were 3 other people on the lease and no one has heard from the management at the apartment. We also provided 2 alternate contact addresses along with 3 cell phone numbers. I'll definitely pay this but will this now affect my credit and credit score? How would I fight this regarding the fact that I did not get any warning or even a phone call? Any input will do..Thanks!

Yes, it can, and will affect your credit, but the good news is that you can dispute their claim. If you can get the others to side with you, and all of you write to the credit bureaus and tell them what happened, then you can get it removed, or at least your side will be on record. In the mean time, sue these rascals, the apartment complex management. They probably never even tried to contact any of you, and simply sent the collection agency the collection notice. It might be their point of view that because of what others have done before you, and their common renters are the type of people who trash and run, that there was no point in trying to contact you to begin with. They need a nice letter from a lawyer stating that what they did was unfair, and you are seeking damages from them for their actions that hurt you, without due cause. What they assume to be true doesn't make it true for everyone. If the other 2 will join the fray, and all 3 of you present a united front to the lawyer, and court, that you were never contacted, then the apartment management is going to have to prove that they did try to contact you 3. They'll have to show that they made a good faith effort, including registered mail that had to be signed for by all of you, as an effort to contact you for the charges involved. It sounds like you have a good case and can make them howl in despair over assuming, rather than taking the time to actually know. You also need to contact the fair housing authority in your city, they should be able to assist as well.

Yes it will affect your credit but you can get it taken off your credit abstract. I would also post this under the law section.

i would call the apartment complex and ask them to send you a bill directly. pay the bill quickly and keep the receipt. keep checking your credit report, the bill may not be on it, if it is once you pay it explain what happened in writing to the 3 credit bureaus and it will help you when you apply for anything and keep your receipt and forward a copy of it to the collection agency. i never pay them a dime.

Just throw the letter from the collection agency in the trash. You don't owe the collection agency any money. They will send a few more bills saying they will take you to court. They won't. Just ignore them.

Well the problems should have been addressed at the time of moving. If you talk to the apartment complex and agree to send prompt payment in return for them removing this from your credit, that may help. If not pay it ASAP.

I think if it gets paid off, the agency will write it off as paid and be just like normal and won't be on your history.

you need to show you made the effort to call them, it might help if you paid for the rug then showed the reciept, but if you weren't behind in the rent then there's no reason for them to have you in with this agency. you need to get your receipts showing you paid your rent on time and be ready to take the complex to court. they will have to show they made the attempt to reason with you and work it out. if you signed a contract including liability for damages this might be all they need to screw you. get a lawyer, get the paper work and still keep trying to work it out. your credit can still be saved! and as soon as this is resolved work it out with the credit report. peace.
