What is a counter-offer on eBay?

Seller lied on Ebay - I don't want the item anymore - he is reporting me to Ebay... What to do?

  • I bid on a phone on Ebay listed as "New, Never Opened" and the description says that the phone is "brand new, in box". After I won the auction, I got a message from another ebayer warning that the seller I bid with does not sell new phones, only used/refurbished phones. I emailed the seller asking if the phone was IN FACT "new, never opened" telling him I expected the phone to be in mint condition, never used, and still in its original packaging. The seller responded saying that the phone is "well refurbished with new parts". He also said that he could not attest to its usage prior to him getting it, and that it will be shipping in a generic phone box. I told him that I bid on a "brand new, never used, in box" phone and I don't want his refurbished phone. He is threatening to report me to Ebay and open an unpaid item dispute, saying that Ebay will make me pay. What am I supposed to do?

    You need to dispute it with eBay. The title and condition say: new and condition also indicates unused. It also says in the description: BRAND NEW BLACKBERRY 7280 If you have an email from the seller admitting it is refurbished, that is what you will need to show eBay. Let the seller report you. Open a dispute for inaccurate listing first. Ebay is set up to protect buyers more so than sellers. They will investigate and then decide if you should have to pay for the item or not based on the condition and the description.

You need to contact ebay and report him. They'll look into the situation and see that it is clearly his problem, not yours, He'll loose his ability to sell.

refurbished isn't brand new, let him dispute it, you'll win as long as you have a copy of the original auction stating it was new and his correspondence stating it wasn't

he has got no come back if he has declared it as new, and if you contact him via ebay on emails, they will be able to see his email stating that it is refurbished, when he has listed it as new. However, if he has put in the description that it has 'new parts' and that it was refurbished, you won't have any come back.

Tell him that you will file a dispute with him claiming that the item he sold you was "Substantially Not As Advertised".
