Can unemployment benefits be denied if employee "voluntarily resigns" even if employer agrees not to contest

unfriendly environment-poor performance review - credibility always under fire by boss - accusatory boss with no proof - employer wants sign off stating "voluntarily resigned" but agrees not to contest unemployment benefits if filed for - will signing off as such, prevent unemployment benefits - must word "involuntarily resigned" "terminated" "dismissed" with verbiage...."as mutally agreed upon by employer and employee effective such and such a date".....be used for employee to receive unemployment benefits? HELP - need immediate answer - today!!!!

If you voluntarily leave a job, you will not be entitled to get unemployment...you must be asked to resign or terminated..your benefits will also be cut if you turn down a new job.

Yes I believe that you may be entitled to unemployment benefits ONLY if you can prove that you were treated unfairly, or you are in an un-safe environment. You must have documentation of the following to be entitled.

okay even if the employer choses not to contest benefits it does not guarantee benefits. Basically, based on the reason for you resignation does no sound like you tried to resolve these issues prior to quitting. If you tried to resolve these issues what proof do you have? basically you quit in lieu of being terminated.

to get unemployment benefits you have to either be fired or laid-off. you cannot get them if you voluntarily quit. sorry.

To get paid you need to get fired. Stick it out or force them to fire you OR use the time to find another job, that might be the best way. Otherwise let the boss know that you can't collect and maybe you could get a severance package.

Typically, to receive these benefits you must be fired or laid off. By voluntarily resigning, you are in theory giving up a perfectly good job, and as such are not entitled to these benefits. Sorry to hear about your scummy boss!
