Ebay purchase?

I purchased an item on ebay for a Christmas gift. In the large overall description area, it states that the item is New In Box. This is the part that I read when deciding to make a purchase. The item arrived without a box and I complained and the seller said that he put NIB in the main title line of the product description. I want to return this item, as I have no use for a Christmas gift that is not in a box, is this something that the seller has to return OR is it something that I am stuck with. The seller is not willing to return the item, but I feel that he should have revised the overall paragraph description of the item. Please help :- )

You can check out eBay discussion boards under community at eBay, to get more information on your options. Without seeing the listing it's hard to judge what your options are. Typically sellers will say right in their auction if they accept returns. They do not have to take the item back, but most people want to avoid negative feedback, and will typically work with someone who is unhappy, of course I think these are people that treat selling on eBay like a business. But if they do not respond negative feedback is an option for you. You could try and relist the item yourself, and hope you'll get what you paid for it back. Hope that helps.

if it says NIB anywhere then it shouldve been in the box, sometimes in the details part they let you choose whether or not you want the box (ie shoes), but he is wrong, if it didnt have a box he shouldve said new without box. You can file a complaint if you want to, but I don't know if that will get you the box obviously he doesn't have it. Is it something that you have to have the box? does it look new?Be very cautious with Ebay and always ask questions if you are unsure.

If they sold you something COMPLETELY different from the description, than YES the seller is compelled to at least exchange the item for the one promised. He/She does not have to refund you, or send you something else he sells, but those options can be done if both parties, you and the seller, agree to them. But like I said, they do HAVE to give you what was promised. They may make YOU pay the shipping to ship the originally WRONG item back to them, which is very common in online or even catalog shopping. If they seller will not agree to any of the above suggestions, I would definitely report him/her to eBay. eBay has the power to remove the seller from eBay, or at the least give them a warning. You should NOT put up with not getting what you pay for - I wouldn't. ALSO, you should look to see if there was any guarantee that came with your purchase? Or if a return policy was already stated on the ad? If so, you have to apply to those, at the seller did clearly state his return policy. For example, if some time has passed since the purchase he/she does not have to accept the return. I suggest for your next eBay purchase to communicate with the seller as much as possible to make sure all of your expectations are met.
