What is Hyundai Lemon Law?

  • I live in Texas and I bought 2010 Hyundai Genesis Coupe few month ago. Ever since I had the car, its been having transmission issue. So the first time, hyundai replace the trasmission to the new one and few month later, same problem was showing on the new trasmission as well. Right now its at the dealership getting transmisson swap again to new one. this is already second time its happening and I really want to get rid of it. recently I've heard about the Lemon Law and I couldn't fully understand what it is. so... what is the lemon law and how can i use this lemon law?

  • Answer:

You need to contact the state and consumer affairs department, or you local assemblyman or senator. each state in the US had different regs on this law. I used to live in NJ and three times on the same issue, would mandate a replacement for the customer. It is a long process, and you have to have all your documentation. And you will have to meet with a consumer advisor for the car company. It is not a cut and dry give the person a new vehicle. BUt you are have issues with a brand new car and would be a candidate. I would also suggest you contact a lawyer and have them become your advocate. The dealership will not want to have the negative report of the lemon law violation. And attorney may do some magic, and the dealership could offer to replace your car and let it simply go away.

A lemon law is a provision that can help an auto owner that has a bunch of problems with a car. It has to be the same problem for each shop visit. You 'might' fit in that category. You will need to confer with an attorney about it. Basically a lemon law says that if the same problem comes up, you should be able to return the car to the dealer without any penalties.

The laws usually vary from state to state. Here in Florida it says if the car is under warranty and you've taken it to the dealer at least 3 times with no successful repair you can file a lemon law claim. I'm having the same problem right now with my Elantra and it's at the dealer right now for the 3rd time.
