Short term or long term tax on equity shares if shares are averaged out?

  • I have bought 100 shares of some company held it for more than 12 months & again I bought 100 shares of same company. Now I have 200 shares ,100 are 12 months old & 100 are 1 month old.Now if sell some 50 shares ,What kind tax is applicable ,Is it Long term or short term.If some one say I need to pay STCG tax I can say I have sold it 50 shares from old 100 lot.But how to distinguish from old lot or new lot as shares are in same demat account. Can some one Please clarify on this kind of transaction.

As the shares of the same company and you want to sell 50 shares then you will have to pay tax for 12 months and not for one month, regardless that you purchased the same shares about one months ago. The transaction will be considered as if you are selling the shares which you had purchased earlier. good luck
