Form 16 not given by employer?

Incorrect Form-16 - Onus of correction?

  • Hi - I received a totally incorrect Form-16 from my earlier employer (it has everything other than PAN and such particulars incorrect). I have communicated to them over e-mail about all the errors and requested for a new Form-16. But given the clout of the Firm, I doubt if I will receive a response. On who does the onus of Form-16 accuracy lie? I know that the values are way off-mark and have reported the same but I cannot force them to issue a new Form-16. Any idea how I need to go about this problem. Thanks in advance. Prasanth

    In this case we need to meet the 'HR' deptt/accounts deptt. of previous employer in person and pursue them to give correct form 16.

Hi Dear No other go, you have to get the revised Form 16 by your employer. Incorrect Form 16 or Form 16A is not at all eligible for the Tax Credit, and Don't be careless by filing a return based on the incorrect Form 16. if you do so Income tax authorities might send you a notice and you will be labile to pay the tax along with penalty and interest by your pocket. Try to convince your employer. Good luck
