What is the different category of service tax in India?

India - "Export of Services" vs. Service Tax Collection following May 2008 Changes?

  • It appears that Indian software companies are now under gambit of service tax starting May 2008. Is there any relief to a company from collecting such service tax if that company is purely exporting these software services to customers in US and Australia . Additional Information: 1. The company is not registered under STPI but 100% of its revenues are from sources outside India. 2. The customers have no establishment in India, and the resulting deliverables from services are used outside India. 3. Payment is being received by company in convertible foreign exchange from sources outside India. Does such a company have to pay service tax on these amounts ? Are there any elements of Dual Tax Avoidance Agreements that come into play ?
