I am employed by Indian Co.,based in India.However remained abroad for more than 182 days in a financial year.?

  • I was given ESOP by our group Co.located out of India 3 yrs back.Exercising of option is due in this financial year.Whether Perquisite tax will be applicable or not since I was more than 182 days abroad in this financial year.My salary is being paid by Indian co.(being deposited in Indian bank account) & debited to foreign co. for which I am rendering the services.Practically I am employee of foreign co. Q. Perquisite tax will be applicable or not.

    if you stay abroad for more than six months in one financial year you are considered an NRI A perquisite is any casual emolument, fee or profit attached to an office or position in addition to the salary or wages. If you have been abroad for more than 182 days, you will be exempted from paying income tax on all income earned abroad. All income earned in India even when you were abroad will attract income tax. Your taxation is not based on the company you work but it is based on your residency and whether the income is foreign or in India. So your ESOP which is earned in India will be taxable after deductions as per rules. Your salary earned in India will also be taxable.
