What Is TDS?

What happens if TDS returns are not filed and issue the TDS certificate?

  • TDS returns for 2007-08 forth quarter are not filed because that TDS payment made on September 2008

  • Answer:

Assuming TDS amount is Rs.20000, then you will be liable to pay interest @ 1% per month (on the TDS amount) for every month of delay i-e from the date on which it is liable to be remitted till the date of actual remittance. So interest amount per month will be Rs.200 (Rs.20000*1% p.m.). Multiply this by number of months of delay.Your interest on delay payment of TDS is arrived at. Delay in filing of e TDS return entails penalty u/s 272A sebsection 2 clause 'c' which is Rs . 100/- per day for the period of default. However, such penalty may not exceed the amount of TDS involved.

You will pay interest on late filing. Also all those you got TDS certifcate will not get credit for TDS deducted. So file as early as possible. For forms for TDS return and dates for TDS returns, read //np http://mytaxes.in/index.php?topic=33.0
