Form 16 not given by employer?

I don't have Form 16 of my previous employer but i need to file IT returns(India). Someone explain?

  • Hi all, I joined a company on november 2010 till current. Now I need to file IT return for this year on Jul 31st. In this company they had given FORM 16 from Nov 2010 to MAr 2011. Now the question is I dont have FORM 16 from Mar 2010 to Nov 2011. What should i do? How to file the IT returns. My previous employer dint issue any FORM 16(my salary also was low) and they dont deduct any TDS etc. Anyone suggest me a good idea. (My salary was 17k/month in previous employer, No deduction nothing... I was taking home all the salary they provide)

    if your total income is below 5 lakhs, u dont need to file income tax return. but, if you like to file ITR you can ask the form 16 from the previous employer. Its no harm to your previous employer to issue the form 16 to the old employee. Even i have changed to a new company during last october and got the form 16 from them. Its a statutory requirement to provide form 16 to employees. Go ahead and ask them the form 16 and file ITR without any hassles.
