Can someone sell our land, if land tax is not paid?
-
My dad has piece of land of about 3000 sq ft. We purchased this land in 90's, in form of Share certificates from co-operative society. We also got legal papers for land in our name. Later we forgot to pay the land tax that is charged by government annually for about 10years. Also the secretary of company changed in these years. New secretary sold our land to some person. He said that as we did not pay the land tax, they gave notice in newspaper and sold it off. Can he do like this? We have papers and certificates, how can they transfer it to someone? Please advise, we are in big trouble.

Answer:
Property that the taxes haven't been paid are sold every year at the local court house tax sale. Sorry but you are out of luck you can't expect to regain something you haven't paid for in years. What they did was totally legal and binding, nothing you can do.

I would say if you did not pay taxes for 10 years they can. I could see maybe forgetting for a little while but 10 years!

Go for an out of court settlement. Court will take 20 years to settle the matter. Legal recourse is the worst solution here.

Many states have a laws on abandoned property, on which it sounds like you "forgot" about the land for about 10 years and did Not pay any of the back real estate taxes. In due course of the law, the state would then give notice (usually published in the local newspapers about the tax lien or seized property) to let the owner come forth to remove the tax lien and pay off the taxes, which it did but you did not come forth to protest or pay off the lien. The state then had the right to seize the land and sell it! Basically, you didn't do what you should have done in those years of paying off the back taxes!

they will remove your name from registry and bring it under government land tax is like a lease you know when a land is bought it is only for 100 years max and then govt can take it any time

Yes the property was abandoned. You did not pay the taxes. The Legal Notice was published according to the law. You still did not respond so property was sold.

Someone purchased a tax lien and at some point sold the land as provided by law.
