If you use a webpage to send the text message, then the owner of the website (such as T-Mobile, Sprint, Cingular) would keep a log of what you send and could cooperate with law enforcement or might share the info with the owner of the cell phone if they open a complaint. If you send the message to the cell phone via e-mail, those are logged too (on T-Mobile, Sprint, Cingular's e-mail server) but probably more difficult to trace.

depends on the network. keep in mind that if you send a message that is deemed inappropriate or harrassing in any way, the cell provider can trace it back to your computer using their in-house software. Also, if the person receiving the message gets the police involved, it takes a subpeonna from the authorities to get the information from the cell company and then you may be pinched. just a heads up.

if it's a violation of national security, then yes. otherwise the process is too tedious that you're probably on the safe side to assume the answer is 'no' in most cases.
