Making minimum wage without keeping tips?

  • I recently started working at a small local restaurant in Florida making minimum wage ($7.25 per hour) but do NOT keep my tips. The first encounter I had with this was while I was training for the first week and one of the customers wanted to personally hand me the tip, but the manager corrected her saying that I'm not allowed to keep the tips. Her rationale was that because some shifts are slower than others resulting in fewer tips, they pay me more hourly instead. After training, a few days after I started working, my manager goes out of town and I am the only server working there everyday for 5 days straight. While I was working, the chef still told me to separate the cash tips from the rest of the bill, but still put it in the register nonetheless. This is my second week working at the restaurant and have not kept any of the tips I have made. I didn't think much of it since this is my first job in addition to my first working experience in a restaurant, but now I'm getting suspicious as to what exactly they are doing with the tips and if it was right for them to keep all of it. Are they "scamming" me by paying me minimum wage as opposed to paying me something sub-par like $2 or $4 something and letting me keep tips? Or do you agree with their logic?

    sounds fishy to me, and kinda sounds like by keeping cash tips separate your boss may be involved in some tax evation. This is risky but it might pay off to, ask him for a cut or you will call the IRS on him, but you'll probably just get fired.

Technically if you are making minimum wage you don't have to get tips. Jobs you keep tips you usually get paid about $3.60 or so and make the rest in tips. I don't understand why they wouldn't "tip out" (pulling all of the tips and splitting them evenly between everyone). I have never heard of a manager telling a customer they can't tip someone either. I would start looking for a new job, this doesn't sound right.
