Is New Zealand law and Australian law similar?

  • This question would probably only be useful to me if you are Australian or A New Zealander. I am studying to be a Legal Executive in New Zealand at present and i am just about to finish the diploma next week.The course is based on New Zealand law and English law as that's were most of New Zealand law comes from. I am planning on moving back to Australia after this is finished but would like to know if there law standards are the same as here and weather this diploma will be of any use over there. I was very young when i left Australia to come to New Zealand so i don't know anything about the law over there. If you could help me out it would be much appreciated.

    Australian law differs from New Zealand law in that there are both State and Federal laws and jurisdictions in Australia. The States differ in their laws in some respects although most are very similar. Federal law overrides State law where the two are in conflict but as the division between State and Federal law is laid down in the Constitution, conflict does not often occur. If you are going to do law in Australia you would need to do a bridging course of some sort.

I'm a kiwi with no background in law. My family is currently in a legal battle with an aunt of mine who "kidnapped" my grandfather and took him to Australia in order to take advantage of his mental infirmity and steal the inheritance, he has since died (y'know, the usual drama). In that experience I've learned that there are definitely differences in gifting laws (I believe New Zealand has a maximum gift value per year where Australia does not). If there are differences like this then I'm sure there will be several others. Whether there are enough to devalue your diploma I am not sure, good luck anyway.

Our laws are basically the same as British law.As the first answer says we have state & federal law.Laws can differ between states but are based along the same lines mostly.
