How do I get a long stay tourist visa for australia for 12 months? and could my baby travel on the same visa?
-
I spent a year in Australia on a working holliday visa, where i met my boyfriend (who is Australian). We don't think that we'll be able to get a partner visa, and don't really want to get married straight away, so we were thinking our best option might be for me to go back there on a tourist visa for 12 months, then after that we could apply for a partner visa. But i don't know if they would grant me a tourist visa if it was to stay with my boyfriend for a year, would it be better if i just said i wanted to travel. He earns enough to support me for that year, so money wouldn't be too much of an issue. Also we're having a baby, due on the 6th of march so he's coming back here (to england) on a tourist visa when the baby's born, so we were thinking after that we could all go back to Oz on the tourist visa for a year, but could the baby travel on my visa with me, or would i have to apply for a separate one?

Answer:
12 month tourist visas are not easy to come by and you are required to show that you have sufficient funds to pay all of your expenses for the whole time. As soon as you say that you don't have the funds but that your boyfriend will be supporting you, you have blown any claim to being a genuine travelling type tourist out of the water. Tell the truth on your visa application. Tell them that you will be staying with your boyfriend and that you intend applying for a spouse visa once you have clocked up your required 12 months cohabitation (but read on). Note that the 12-month relationship requirement may be waived if you can demonstrate compelling and compassionate circumstances, such as if you have children with your partner. I believe that you should consider lodging a spouse visa application as the baby may provide sufficient grounds for a waiver. Your baby will have an Australian citizen parent so will be eligible for Australian citizenship by descent. Apply for that as soon as s/he is born and get an Australian passport for him/her - visa problem solved. If you don't get an Australian passport for the baby, it will require its own visa if it isn't included on your passport. http://www.citizenship.gov.au/applying/how_to_apply/descent/
