What is a claim back pension?

Can I claim a state pension from the UK if I am back in Ireland?

  • I worked in the UK for 12 years. I am now back working in Ireland for the last 11 years. I am irish. When I reach pensionable age, am I entitled to claim a state pension of some kind from the UK? I paid my taxes, national insurance etc throughout my time there.

  • Answer:

I think so but I also think that whatever Britain pays you will be deducted from your pension here. At least that's what I've been told. Someone I know is going to Spain to retire. They have worked in Britain and Ireland and their pension will be made up by contributions from both countries, but will still just equal the State pension that everyone else gets.

Yes, but you have to work at least 30 years to get a full state pension, so you won't get much.

Yes, as far as I'm aware you can. It may not be much, but you did pay your share. Assuming you had an RSI number etc.

Yes.

Speak to the Department for Social Protection here in Ireland - you'll probably find that they'll combine the contributions you made in the UK with those you make in the Republic of Ireland but you won't be able to claim a complete pension from the UK because you didn't work there long enough http://www.citizensinformation.ie/en/social_welfare/social_welfare_payments/older_and_retired_people/state_pension_contributory.html

I would think so too! My mother worked over 14 years in the UK and lives now in Germany and receives a small pension, after writing to the Department of Work and Pension! So I assume if you dont apply for it yourself, you wont get it than. http://www.direct.gov.uk/en/Pensionsandretirementplanning/TaxandNationalInsuranceinretirement/GettingyourtaxandNationalInsuranceright/DG_10014855

http://www.hmrc.gov.uk/cnr/osc.htm contact HM customs and revenue ......... don't expect great help as the are very bad at giving any and regardless of what info you get from them unless it is exactly what you think you should get....ask again and keep trying make sure you have you NI number on everything and keep copies of all letters you send.....................go to your Citizens Advice Bureau if you need help.........or better still contact your own Tax office in Ireland and ask as I think you can have any credit years earned transferred towards your Irish pension.................................…

when you apply for your pension, you will be asked if you worked overseas the pension office will check with the uk benefit agency and the contributions you made there may be used as credit towards your irish one instead as you need 30 years worth of contributions to get basic pension.

Yes, you can… but you need to be clear about the steps involved and the possible legal issues that could arise. A better option is to get assistance from experts who could guide you in the right path for reclaiming your payment. You can find more information about claiming payment online in sites like.. http://www.realclaims.co.uk/
